1. What AI Underwriter is

AI Underwriting is an investment analysis and diligence-support tool. Outputs are based on user-provided inputs, third-party data where available, source-status metadata, and deterministic financial modeling. Outputs are not appraisals, broker price opinions, credit decisions, lending commitments, agency approvals, legal advice, tax advice, accounting advice, securities advice, or investment recommendations. Users are responsible for independent verification before relying on any output.

2. Acceptable use

You agree to use the service only for legitimate commercial real estate analysis. You will not upload data you do not have rights to, attempt to reverse-engineer the engine, or use outputs to mislead third parties about the source of the analysis.

3. Subscriptions and billing

Paid plans renew monthly via Stripe. Included deal runs reset monthly. Overage charges apply after included usage. Premium memo mode is optional and may create additional usage charges. You can cancel anytime from your billing portal; cancellation takes effect at the end of the current billing period.

4. Data ownership

You own your uploaded deal data. With your consent, we may anonymize and aggregate selected deal, bid, and outcome data to improve benchmarks and product quality. We do not sell your identifiable deal files. You can revoke eligible data-sharing permissions in settings.

5. No warranty of outcome

The service is provided as-is. We do not guarantee that outputs are accurate, complete, current, or fit for any particular lender, agency, or transaction. We do not predict lender or agency decisions. Document-completeness signals are not deal-quality scores. Independent professional review is required before reliance.

6. Limitation of liability

To the maximum extent permitted by law, AI Underwriting and J&A Higgins Enterprises, LLC are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption arising from use of the service. Aggregate liability for any claim is limited to the fees you paid us in the twelve months preceding the claim.

7. AI use and providers

AI-generated narrative is produced through OpenRouter as our unified provider, with downstream models that include DeepSeek, Z.ai/GLM, and Anthropic. The active model registry lives in code (MODELS in packages/ai/src/openrouter-client.ts) and may change as we tune routing. AI may produce errors, omissions, or hallucinations. All numeric values shown in reports are bound to deterministic engine outputs and trace through per-field source maps; narrative is a draft and is not advice.

AI Underwriting is not a registered investment advisor, broker-dealer, fiduciary, or securities issuer, and nothing in the service is a recommendation to buy, sell, hold, finance, or refinance any property or security.

9. AVM and appraisal non-claim

Property valuation estimates are not Automated Valuation Models under 12 CFR 1026.42(i). They are not intended for use by mortgage originators or secondary-market issuers in determining the collateral value of a consumer principal dwelling. This analysis is not a USPAP-compliant appraisal. It is an investment-analysis tool. Engage a state-licensed or certified appraiser for appraisal purposes.

10. Data sources

Property data provided in part by ATTOM Data, public records, SEC EDGAR, FRED, U.S. Census Bureau, and HMDA. Sources are cited per data field in the source-map appendix of every generated report.

11. Limitation on use

You will not use the service, its outputs, or any derived materials for collateral valuation of a consumer principal dwelling under 12 CFR 1026.42, for credit decisions about consumers, for consequential decisions about employment, lending, healthcare, education, housing, or insurance, or for any purpose that requires a USPAP-compliant appraisal, a broker price opinion under state license, or a registered investment-advisor recommendation. The service is sold for commercial-property investment analysis only.

12. Changes

We may update these terms. Material changes will be communicated by email to the address on your account. Continued use after the effective date of an update constitutes acceptance.
